How Fault Works in Texas
Texas uses a system called modified comparative negligence, also known as the proportionate responsibility rule. Under this rule, each party involved in a crash is assigned a percentage of fault. You can recover compensation as long as you are 50 percent or less at fault.
However, your compensation is reduced by your percentage of fault. If your damages total $100,000 and you are found 20 percent at fault, your recovery is reduced by $20,000, leaving you with $80,000.
The other driver's insurance company knows this rule well. Their job is to assign as much blame to you as possible, because every percentage they shift onto you reduces what they have to pay. They will look for anything they can use: speeding, distracted driving, failure to signal, or even the angle of your vehicle.
