How a Texas Civil Case actually works
Most cases settle at or before mediation. Here is what to expect at each stage.
Petition and Answer
2 to 6 weeksThe plaintiff files a petition laying out the claims. The defendant must file an answer within the deadline set by the citation, usually 20 to 30 days. This stage sets the scope of the dispute.
Discovery
3 to 9 monthsBoth sides exchange documents, take depositions, and serve written questions. This is the longest phase and where most cases are won or lost. The facts come out here.
Mediation
1 to 2 monthsA neutral mediator guides both sides toward settlement. Most Bexar County civil courts require mediation before trial. The majority of cases resolve at this stage.
Trial
1 to 3 years totalIf settlement fails, the case goes to a judge or jury. Trials are rare but we prepare every case as if it will reach one. Being ready is what drives fair settlements.
Should You sue, settle, or send a demand letter?
Not every dispute needs a lawsuit. Sometimes a well-written demand letter from a lawyer is enough to get the other side to the table. Sometimes filing suit is the only thing they respect. And sometimes, the cost of litigation outweighs what you stand to recover.
We help you think through the tradeoffs. What will this cost in attorney fees and court costs? How strong is the evidence? What is the realistic range of recovery? Is the other side collectible, meaning can they actually pay if you win? A judgment against a company that has no assets is an expensive piece of paper.
We will tell you honestly if litigation is the right path, if a demand letter will do the job, or if the numbers do not justify the fight. That honesty is worth more than any claim of aggressiveness.
Demand Letter
A formal letter laying out your claim and a deadline to respond. Fast, low cost, and often effective for smaller disputes.
Settle
Negotiation or mediation without filing suit. Best when both sides want to avoid court costs and the outcome is predictable.
File Suit
When the other side will not respond or the stakes justify it. We prepare every case for trial from day one.
Fees and How this is billed
We bill civil litigation in one of two ways depending on the nature of the matter.
Hourly
Most commercial litigation is billed hourly. A retainer is collected up front and drawn down as work is performed. You receive detailed billing statements showing the work done and time spent. This applies to breach of contract, business disputes, construction matters, and property litigation.
Contingency
Certain collection matters and some fraud or DTPA claims may be taken on contingency, meaning we only get paid if we recover. Whether a matter qualifies depends on the strength of the claim and the collectibility of the defendant. We discuss this with you at the first meeting.
